Because “no living creature can speak falsely or fail to answer” when the Question is asked at Trenzalore.
Moffat thrives on minor technicalities like that.
While that’s true, I think it’s more likely that the quote of “no living creature can speak falsely or fail to answer” was referring to the Doctor’s final visit to Trenzelore when he dies. If that wasn’t the case, why didn’t the Doctor answer when asked?

We back away from the angst and I ask her if she knows where she’s seen John Hurt before. She says he looks familiar but she’s not sure. I show her an image of him holding a wand and she says, “Harry Potter. It seems like just yesterday I was giving your mother and father their first wands.” In perfect mimicry of the accent too.
